In order to provide our customers
with the best possible service, products, and pricing, the
following terms and conditions
are established for our customers... Merlin Stelzer Sales
Company (MSS) requests that you carefully read the terms
and conditions. By using the www.merlinstelzer.com website
or the www.stelzersales.com website you agree to these
terms and conditions. For the purpose of this document
MSS denotes both websites and the company itself.
MSS may contain other proprietary notices and copyright
information, the terms of which must be observed and followed.
Information on this site may contain technical inaccuracies
or typographical errors. Information, including product pricing
and availability, may be changed or updated without notice.
We reserve the right to refuse service, terminate accounts,
and/or cancel orders at our discretion, including, without
limitation, if we believe that customer conduct violates
applicable law or is harmful to the interests of MSS.

Orders shipped to Missouri and Illinois will be charged
appropriate sales tax.
Copyright
All software and content included on this site, such as text,
graphics, logos, button icons, images, audio clips, and
software, is the owned or licensed property of MSS or its
suppliers and is protected by U.S. and international copyright
laws. We grant you use of this site for information regarding
the purchase of goods or services from MSS. Any other use,
including the reproduction, modification, distribution,
transmission, republication, display, or performance, of
the content and software on this site is strictly prohibited. Privacy
To complete a transaction
it will be necessary for the customer to give personal
information. We do not use information
for anything other than its intended use.
We do not sell or transfer any customer information to third
parties Pricing
Product pricing may be volatile, based upon the market.
We will inform the customer of any changes prior to shipment.
This is a rare, but possible event.
Payment Methods

Credit Cards. We accept most major credit
cards including Visa, MasterCard, Discover, and American
Express. There are no credit card surcharges. Please
be sure to provide the exact name, billing address, and
telephone number as they appear on the credit card statement.
You may also be required to provide the last three digits
of the number which appears above the signature area
of your card (V-code). Incorrect information may cause
a delay in the processing the order. Orders that are
shipped to an address other than the billing address
listed with the credit card company require a temporary,
alternate shipping note added to the account. |

A $25.00 returned check fee will be assessed on all returned
checks, plus collection costs if required.
Delinquent Accounts
Pricing
and service are based on payment within terms, therefore
a monthly service charge of 3% per month will be assessed
on all past due balances. All purchases remain the property
of MSS until paid for in full. Peaceful repossession of
any merchandise not paid for within terms will be allowed,
as will the reimbursement of any reasonable collection
fees, legal fees, and/or court costs. On contract work,
it is our policy to file mechanics liens on any projects
where billing has not been paid within terms. Accounts
with balances past due will be placed on C.O.D. status. Minimum Orders
Other than for cash, all sales will carry a $25.00 minimum
billing amount.
Shipping
F.O.B. 4109 Papin St. - Most shipments will have freight
charges prepaid and added. All special orders are F.O.B.
Factory. While we take effort to control our shipping rates,
our published shipping rates are subject to change at any
time. We will inform the customer of any changes prior to
shipment. Special shipping, air freight, same day delivery,
etc. is normally available for a reasonable fee. International
shipping is available, but subject to limitations
Return shipping is the responsibility
of the customer. See the "Returns" section of
this document for additional requirements.
Warranties
The Merlin Stelzer Sales Company offers no implied or expressed
warranty or guarantee on the products we sell as to their
manufacture, suitability for application, or any other issue
or aspect relating to the sale, shipment, or correspondence,
written, electronic, or oral. Any warranty is provided by
the manufacturer of the product sold.
We will process all warranties on products we sell based
on the conditions of each manufacturers' policy. Such warranties
are normally for defective materials or workmanship only
and are only for a limited time period. They normally do
not cover misuse, damage, regular maintenance, or normal
wear and tear. Please be sure to indicate if an item is to
be handled under warranty. Proof of purchase will be required
for warranty work.
Links to other Websites
The MSS site may contain links to other websites to provide
you with information regarding products or services we offer.
We are not responsible for the accuracy or efficacy of the
information on other sites.
Returns
Returns must be approved in advance by MSS and may be subject
to a restocking charge. Products must be in original saleable
condition and returned within 30 days of sale. Custom orders
are not returnable. Return shipping is the responsibility
of the customer. MSS should be informed prior to shipment
that the product is being returned, along with the reason
for return. We prefer that e-mail be used, and request that
the customer wait until return authorization is received
prior to shipping the return.
International Orders
While we can accept International (non USA)
Orders, we reserve the right to refuse an order for any reason.
Due to the nature
of payment systems internationally, special requirements
may apply to the transaction. We reserve the right to modify terms and conditions and pricing
without notice.
All business is conducted under the laws of the United States
of America, and the State of Missouri, and any dispute or
litigation arising from a dispute will be brought in the
City of St. Louis, State of Missouri.
Indemnity
Customer agrees to hold harmless and indemnify the Merlin
Stelzer Sales Co., Inc., its officers and their employees
therefrom, arising out of or as a result of any act or
failure to act in connection with the materials supplied
or the work contracted under any sales agreement, or with
regard to any activity relating to MSS or the internet.
